Scope of this policy

Electrotk operates this website, online store and the related information, product-sourcing, quotation, customer-support and transaction services referred to in this policy as the Services. Shopify provides the ecommerce platform used to deliver the Services.

This policy explains how Electrotk collects, uses, stores and discloses personal information when you browse the store, create an account, request a quotation, submit a manufacturer part number, place an order, subscribe to updates or otherwise communicate with us.

“Personal information” means information about an identifiable individual. Information that has been irreversibly anonymised so that an individual cannot reasonably be identified is not personal information for the purposes of this policy.

Information we collect

The information we collect depends on how you interact with Electrotk and may include:

  • Identity and contact information: name, company, email address, billing and delivery details and contact number supplied for an order or enquiry.
  • Order and transaction information: products, quantities, order history, returns, refunds, shipping status, invoices and payment confirmation.
  • Technical and sourcing information: manufacturer, MPN, product series, application, compatibility requirements, requested delivery date, equipment information and documents supplied with an enquiry.
  • Account information: account credentials, preferences and saved details where customer accounts are enabled.
  • Communications: messages, support requests, warranty claims, feedback and other information you choose to provide.
  • Device and usage information: IP address, browser and device type, network identifiers, pages viewed, referring pages and interaction with the Services.
  • Marketing preferences: subscription status, consent records and engagement with messages we send.
Payment details

Payments are processed by Shopify and the payment providers available at checkout. Electrotk does not ordinarily receive or store your complete payment-card number or security code. Payment providers may collect and process payment and fraud-prevention information under their own privacy terms.

Where information comes from

We may obtain information:

  • directly from you, including through orders, forms, accounts, emails and enquiries;
  • automatically through cookies and similar technologies when you use the website;
  • from Shopify, payment providers, delivery providers and other suppliers supporting the Services;
  • from a company, colleague or authorised representative acting for you; and
  • from lawful public or commercial sources where reasonably necessary to verify a business, transaction, product or sourcing enquiry.

Where New Zealand law requires notice when we collect personal information indirectly, we will take reasonable steps to provide that notice unless an applicable exception permits otherwise.

How we use personal information

We may use personal information to:

  • provide, administer and improve the Services;
  • respond to product, compatibility, availability and sourcing enquiries;
  • prepare quotations and communicate pricing, lead times and delivery options;
  • process payments, fulfil orders and arrange domestic or international delivery;
  • manage accounts, returns, refunds, warranties and customer support;
  • verify orders, customers, businesses or transaction details where reasonably required;
  • detect, investigate and prevent fraud, misuse, security threats and unlawful conduct;
  • maintain business, tax, accounting, warranty and transaction records;
  • send product updates or promotional communications where you have consented or where otherwise permitted by law;
  • analyse website performance and improve catalogue navigation, product information and customer experience; and
  • comply with legal obligations, respond to lawful requests and establish, exercise or defend legal claims.

If you do not provide information that is reasonably required for an order, quotation or sourcing request, we may be unable to process that transaction or provide the requested service.

How we disclose personal information

We may disclose relevant personal information to:

  • Shopify and technology providers that host, secure, analyse or support the store;
  • payment and fraud-prevention providers used to authorise and protect transactions;
  • couriers, freight forwarders, customs agents and delivery partners involved in fulfilling an order;
  • manufacturers, distributors and sourcing partners where reasonably required to confirm availability, compatibility, warranty, pricing or supply options;
  • professional advisers such as accountants, insurers, auditors or legal advisers;
  • regulators, courts, law-enforcement bodies and government agencies where disclosure is required or permitted by law; and
  • a prospective purchaser or successor in connection with a genuine restructuring, sale or transfer of the business, subject to appropriate confidentiality protections.

We seek to disclose only the information reasonably necessary for the relevant purpose. Service providers may process information only to provide their services to us or as otherwise described in their applicable privacy terms and permitted by law.

Overseas disclosures

Shopify, payment services, cloud providers, manufacturers, distributors and delivery partners may operate or store information outside New Zealand. When Electrotk makes an overseas disclosure, we will take reasonable steps required by New Zealand Privacy Principle 12, or rely on another lawful basis or applicable exception. Information processed by an overseas provider acting solely as our agent may be handled under arrangements designed to preserve appropriate privacy safeguards.

Cookies, analytics and marketing

Cookies and similar technologies help the store operate, remember preferences, maintain a cart, protect checkout, understand website use and improve product discovery. Some cookies are necessary for the Services to function. Other analytics or advertising technologies may depend on your choices, device settings and applicable law.

You may control cookies through the consent controls made available on the website and through your browser settings. Blocking necessary cookies may prevent parts of the store or checkout from working properly.

Commercial messages

We send promotional electronic messages only where we have the required consent or another lawful basis. Messages will identify Electrotk and include a clear method to unsubscribe. You can unsubscribe at any time using the link in a marketing email. We may still send service messages relating to an enquiry, account, quotation, order, delivery, warranty or legal notice.

Our relationship with Shopify

Shopify hosts the Electrotk store and processes information about your access to and use of the Services so it can provide, protect and improve its platform. Information submitted through the store is transmitted to Shopify and may also be processed by Shopify-affiliated services and other providers in countries outside New Zealand.

Shopify may process certain information for its own purposes, including platform security, fraud prevention, analytics and eligible enhanced ecommerce features. Security, accuracy and retention

We use reasonable safeguards appropriate to the nature of the information we hold. No internet transmission or storage system is completely secure, and we cannot promise absolute security. Please do not send passwords, full payment-card details or other unnecessary sensitive information through ordinary email or enquiry forms.

We take reasonable steps to keep personal information accurate, current and relevant for the purpose for which it is used. Please contact us if your information changes or you believe it is incorrect.

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including completing transactions, supporting products, maintaining warranty and accounting records, resolving disputes, preventing fraud and meeting legal obligations. Information may then be securely deleted, destroyed or anonymised where appropriate.

Privacy breaches

If a privacy breach has caused or is likely to cause serious harm, Electrotk will notify the Office of the Privacy Commissioner and affected individuals as soon as reasonably practicable, as required by the Privacy Act 2020.

Your privacy rights and choices

Subject to the Privacy Act 2020 and any applicable exceptions, you may:

  • ask whether we hold personal information about you;
  • request access to personal information we hold about you;
  • request correction of information you believe is inaccurate or incomplete;
  • ask us to attach a statement of correction if a requested correction is not made;
  • withdraw consent for future marketing communications; and
  • raise a concern or complaint about our handling of your information.

We may need to verify your identity or authority before releasing or changing information. We may refuse or limit a request only where permitted by law and will explain the applicable reason where required.

Children

The Services are intended for adults and businesses and are not directed to children. We do not knowingly collect personal information from children without appropriate authority. A parent or guardian who believes a child has supplied information may contact us to request appropriate action.

Third-party links

The Services may link to manufacturer, delivery, payment, social-media or other third-party websites. Those sites operate under their own privacy and security practices. Electrotk is not responsible for how an independent third party handles information you provide directly to it.

Contact Electrotk if you want to exercise a privacy right or have a concern about how your personal information has been handled. Please include enough information for us to identify and respond to your request, but do not send unnecessary sensitive information.

If we cannot resolve your concern, you may complain to the Office of the Privacy Commissioner.

Changes to this policy

We may update this Privacy Policy to reflect changes to the Services, our practices or legal requirements. The revised version will be published on this page with an updated effective date. Material changes will be communicated where required by law.
