Terms of Service
The terms applying when you browse, enquire, request a quotation or purchase from Electrotk.
01Orders, quotations and acceptance
Website listings and quotations are invitations to place an order. An order is accepted when we confirm acceptance or dispatch the goods. We may correct genuine pricing, description or availability errors before acceptance and will offer cancellation and refund of any payment if we cannot accept an order.
Quotations remain valid for the stated period and are subject to availability, freight, tax, currency and any written conditions.
02Product selection and technical information
You are responsible for confirming the MPN, revision, compatibility, voltage, protocol, safety rating, certification and suitability for your application. Our product information and sourcing assistance are general commercial support, not engineering design, functional-safety validation or professional certification.
Always use current manufacturer documentation and appropriately qualified personnel. We remain responsible for express representations and obligations imposed by law.
03Pricing and payment
Prices, tax treatment and currency are shown at checkout or in the quotation. Payment must clear before dispatch unless approved credit terms apply. We may suspend performance for overdue amounts and recover reasonable enforcement costs where lawful.
04Product condition and lifecycle
Products are supplied new unless the listing or quotation expressly states otherwise. Some products may be discontinued, obsolete or no longer supported by the original manufacturer. Lifecycle status does not itself mean the item is used, but availability, firmware support and manufacturer warranty may differ and will be disclosed where known.
05Software and intellectual property
Software, firmware and digital products are licensed rather than sold and remain subject to the owner’s licence terms. Product names, marks, documentation and images belong to their respective owners. Purchase does not transfer intellectual property rights.
06Liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental or consequential loss, loss of production, revenue, data or opportunity, except where liability cannot lawfully be limited. Electrotk’s aggregate liability for a claim is limited to the amount paid for the affected goods, except to the extent a higher remedy is required by law.
You are responsible for safe system design, backups, redundancy, installation, commissioning and compliance. These limits do not apply to fraud, wilful misconduct or any liability that cannot be excluded.
07Business-to-business purchases
Where you acquire goods in trade, both parties are in trade, this agreement is in writing, and it is fair and reasonable, the parties agree to contract out of the Consumer Guarantees Act 1993 and the permitted provisions of the Fair Trading Act 1986. This clause does not apply to consumer purchases and operates only to the extent legally effective.
08Governing law and changes
These terms are governed by New Zealand law. Updated terms apply to future use and orders, not retrospectively to accepted orders unless agreed or required by law. If any term is unenforceable, the remainder continues.
